SKITTER TV SERVICE AGREEMENT

Please read, sign and return before your install date

Thank you for choosing STE Skitter TV. This is a service agreement between STE Skitter TV and you as our valued subscriber. Please keep a copy for your records. Allowing STE Skitter TV to install its services indicates your acceptance of these terms. Accordingly they will be legally binding on you. Subscriber declares that they are legally able to enter into this agreement.

SERVICE: Subscriber will receive standard installation and equipment. Subscriber agrees to subscribe to the core programming package of STE Skitter TV. STE may raise programming rates, modify programming packages, and make any other changes to the terms and conditions under which STE Skitter TV offers service. Any changes will be sent to subscriber via the U.S. Postal Service or regular monthly billing. Subscriber must use this service for their private, non-commercial, residential use only. Subscriber acknowledges that some programming may “blackout” due to content provider’s obligations. STE Skitter TV is not responsible for any programming content presented on STE Skitter TV. This contract is non-transferable and is unavailable in conjunction with any other promotion.

MANDATORY MAINTENANCE FEE: A mandatory maintenance fee of $5.00 per month will be charged to your account. This fee covers all STE Skitter TV-owned equipment and the labor related to the maintenance of this equipment, plus unlimited phone technical support.

BILLING: You will be billed monthly for your STE Skitter TV in advance. Remittance is due upon receipt and considered past due on the 21st day of the month following billing, if not received at the STE Skitter TV office in Steelville, Missouri, service will be terminated during the month following the month of delinquency. In addition to the subscribed services, subscriber is responsible for all applicable federal, state, local and government fees. Subscriber must contact the STE Skitter TV home office for any billing disputes. Regardless of any dispute, subscriber must remit any balance due. Should it be found that the subscriber is correct in the billing dispute, the subscriber will either be credited the disputed amount, or a refund will be mailed to the subscriber. Subscriber authorizes STE Skitter TV to obtain a credit check, report any delinquent payments to credit reporting agencies, and is responsible for any collection fees.

EQUIPMENT: Subscriber acknowledges that any equipment provided by STE Skitter TV is the property of STE Skitter TV.

Subscriber agrees not to damage or misuse STE Skitter TV equipment and to return it to STE Skitter TV when service is terminated, in the same condition as when installed, reasonable wear and tear accepted, and in reusable condition, consistent with any requirement of law. Return of equipment is required when terminating service. If the equipment is destroyed by the subscriber, the subscriber is held accountable for the full cost of the equipment. Any attempt by the subscriber to tamper, reconfigure or alter any STE Skitter TV equipment is strictly forbidden. Any subscriber attempts to tamper, reconfigure or alter STE Skitter TV equipment that result in additional, upgraded or enhanced services is considered theft of services and will be referred to local law enforcement for prosecution at the sole discretion of STE Skitter TV.

COSTS FOR DAMAGED OR MISSING EQUIPMENT: As technology changes, STE Skitter TV may utilize equipment not listed in this section. This does not release the customer from the obligation to reimburse STE Skitter TV for damaged or missing equipment.

NO TRANSFER: No service or STE Skitter TV equipment may be transferred to another person without the prior written consent of STE Skitter TV. Service may not be shared with any person not a part of Subscriber’s immediate household.

NO WARRANTIES: STE Skitter TV makes no warranties, expressed or implied in this document or in any related agreement including but not limited to any warranty regarding the merchantability, fitness for any particular purpose, designed, conditions of, or quality of material or workmanship of any service or equipment.

LIMITATIONS OF LIABILITY: To the maximum extent permitted by law, STE Skitter TV disclaims liability for any claim, loss, damage, or expense of an kind or nature arising from or in any manner related to the provision of the service procured by the subscriber, or to any equipment, including without limitation any liability caused directly or indirectly by; 1) the inadequacy of the service or equipment to serve the subscriber’s service; 2) any deficiency or defect in the service or equipment; 3) the use or performance of the service or equipment; 4) any interruption or loss of profits or revenue, or any other consequential damages of any kind, whether or not resulting from any of the foregoing.

CERTAIN LOSS OF SERVICE DUE TO CUSTOMER: Any loss of service availability caused by action or inaction by customer, or by defect or failure of subscriber’s equipment, will not suspend the obligations to pay for service, and subscriber shall remain liable for all applicable charges.

STANDARD INSTALLATION: Standard installation includes placement of Set Top Boxes, hardware and wiring for up to three TVs.

STE Skitter TV reserves the right for its employees to use their discretion to complete the installation in most efficient, non- invasive manner possible. Any additional equipment and labor needed beyond standard installation may be an additional charge at the current STE Skitter TV equipment costs and labor per hour rates.

CANCELLATION: Service will be disconnected on the day requested and billing will be prorated as necessary. Early contract termination fees apply. STE Skitter TV reserves the right to cancel this agreement at any time.

PRIVACY: This agreement is subject to the privacy agreement on file with STE.
